China Announces RoHS 2 Conformity Assessment System

 

On October 17, 2019, China’s Ministry of Industry and Information Technology (MIIT) released the China RoHS 2 Conformity Assessment System. The online platform will enable companies that produce electronics and electrical components and sell in Chinese marketplaces to upload information regarding RoHS restricted substances in their products. While the voluntary guidelines do not come into force until March 1, 2020, the first reporting period deadline is November 1, 2019.

 

Two Types of RoHS Due Diligence

 

1. Self Declaration

2. Third-Party Certification

Self-declaration

 

Companies can elect to run their own due diligence programs and self-report their product(s) compliance status on the China RoHS Conformity Assessment System. Companies who have previously run due diligence programs for the EU RoHS 3 regulation may find some of their EU RoHS 3 supplier data useful as many of the same chemicals apply.

 

Third-party Certification

 

The other option is to use a third-party certification body. According to Chemical Watch, there are an estimated 20 labs that have been approved by the Certification Accreditation Administration who can serve as third-party certification bodies for China RoHS 2.

 

RoHS 2 Compliance Violations

 

According to the Chinese State Administration of Market Regulation, the violations that occur in the voluntary certification by the State and self-declaration activities shall be punished according to laws and regulations, and the administrative punishment information of the enterprises shall be publicized to the public through the national enterprise credit information publicity system and public service platform.

  • Cadmium (Cd)
  • Hexavalent chromium (Cr6+)
  • Lead (Pb)
  • Mercury (Hg)
  • Polybrominated biphenyls (PBB)
  • Polybrominated diphenyl ether (PBDE)
